ECOLOGY & CO — CROWDFUND NZ TERMS & CONDITIONS

1. Introduction

These Terms and Conditions apply to Ecology & Co’s New Zealand Crowdfund campaign, offered exclusively to customers with a New Zealand delivery address via:

By placing a pledge or pre-order on this page, you acknowledge that this is not a standard retail purchase, but a crowdfunded pre-order for products that are not yet manufactured and will be delivered at a future date.

These Terms are governed by New Zealand law.

3. Nature of the Crowdfund / Pre-Order

By pledging or purchasing through this crowdfund page, you understand and agree that:

This is a pre-order / crowdfunding pledge, not an immediate purchase of in-stock goods.
Products are currently in development and production will commence after the campaign closes.
Final packaging, flavour profile, or minor product specifications may vary from images or early prototypes.
Delivery is estimated by the end of March 2026, but may shift depending on production, supply chain, or regulatory timing.
You will be kept updated via email throughout the process.

4. NZ-Specific Notice on Every Product Page

Each product page includes the following required disclosure:

“PLEASE NOTE THIS IS AN NZ-SPECIFIC PRE-ORDER PLEDGE AS PART OF OUR CROWDFUND CAMPAIGN AND WILL BE DELIVERED BY END OF MARCH 2026.”

This notice forms part of these Terms.

5. What Your Pledge Includes

Each pledge tier clearly states what is included. For example:

“Three boxes, one of each flavour — 12 cans total.
This pledge includes 6 x 4-can packs:
• 1 x 4-pack Mellow Manuka Spritz
• 1 x 4-pack London Dry & Tonic
• 1 x 4-pack Spice & Citrus Soda

By purchasing today, you are securing your product at our NZ specific crowdfund rate.”

6. Pricing, Currency & GST

All prices on this NZ crowdfund page are shown in NZD and include GST unless otherwise stated.
Pricing here applies only to NZ customers.
International customers must pledge via our global crowdfund channels.

7. Shipping & Delivery

Shipping is NOT included in your pledge.

You will be contacted closer to dispatch to:

Confirm your delivery address, and
Pay the shipping fee separately.

You agree that shipping rates may vary at the time of dispatch based on courier pricing at that date.

Estimated delivery date:

End of March 2026 — subject to reasonable production and supply-chain variation.

We will notify you of:

Production updates
Any delays
When shipping is ready to be charged
When your order is dispatched

If significant delays occur beyond what is reasonable, you may request a refund (see Section 9).

8. Changes, Delays & Unforeseen Circumstances

Because this is a crowdfund, the following may occur:

Ingredient availability changes
Production schedules shift
Packaging or design updates
Supply-chain disruptions

If the changes are material or delivery becomes unreasonably delayed, we will communicate promptly and offer appropriate remedies, which may include a refund.

9. Refunds & Cancellations

Change-of-mind refund (voluntary)

We offer a 14-day refund window from the date of your pledge.

To request a refund within 14 days:
Email us at hello@ecologyandco.com with your order number and “Crowdfund Refund Request”.

After 14 days

Refunds will only be provided if:

We significantly change or cannot supply the product,
Delivery delays become unreasonable, or
Goods are faulty or do not meet the guarantees under the Consumer Guarantees Act 1993 (CGA).

CGA Rights

Nothing in these Terms limits your rights under the CGA or the Fair Trading Act (FTA).
If your product is delivered faulty, unsafe, or not as described, we will meet our legal obligations.

10. Consumer Guarantees

Once goods are delivered, you are entitled under the CGA to:

Goods of acceptable quality
Goods that match the description
Goods that are fit for purpose

If there is an issue, we will offer repair, replacement, or refund as required by law.

11. Product Descriptions & Claims

We aim to describe our products accurately.
Because these products are in development:

Images shown may be prototypes
Flavour, colour, or packaging may vary slightly
Any botanical or ingredient references relate to flavour and crafting, not therapeutic benefits

We do not make health or medical claims.

12. Privacy & Data Use

When you pledge, we collect personal information to:

Process your pre-order
Communicate campaign updates
Arrange shipping when the product is ready

We comply with the New Zealand Privacy Act 2020.

13. Liability

To the extent permitted by New Zealand law, Ecology & Co is not liable for:

Delays caused by events outside our control
Losses that are consequential, indirect, or not reasonably foreseeable

Nothing here limits your rights under the Fair Trading Act or Consumer Guarantees Act.
